please verify that smail is suid root.
soenke@escher:~$ ls -l /usr/sbin/smail
-rwsr-xr-x 1 root root 272508 Jan 21 20:09 /usr/sbin/smail

The missing suid-bit may indicate that you missed something in the
installation, just my 0.02$.
