You are right. It still intrigues me that paragraph creates a headline, while subsection does not (I have just made some tests with subsection right after section, and no page break is put between them); it is strange, isn't it? Lamport's book does not speak about it.
What are you trying to label here in the first place? As it stands, the label boz would refer to the section and should therfore follow that.
You are right, it is useless here. Still a bug is a bug, no matter if a useless thing exists or not.
