Bug#171406: epstopdf and 90 degree rotation

I read at

about your followup on a problem with epstopdf and the resulting 
rotation.

I've found that the existance of "%%Orientation: Portrait" in the EPS
file is the deciding factor.  If this is present, the "Rotate 90"
instructions will be in the PDF and it will show up wrong.  If this
line is not present, all is well.

Do you know, is this a epstopdf issue or a GhostScript issue?

FYI: I'm using gs version 7.05-1.
