No, I cannot see any side effects. Yes, it works with gs, even on potato.
Also, I fail to see why this could possibly be a criterion.
If this patch does not get applied, .pdf files created from .eps files on
woody can be rotated by 90 degrees with respect to potato. This results
in screwed-up documents later prepared by pdflatex, with figures being
way too large (in addition to rotated), hence accumulated on the end of
each chapter and stuff like that. Now, *that* is a regression from
potato. We currently have this situation and Pedro's patch fixes it.
