I just wanted to follow up on this.

Is it the case that the patch must be applied to the kernel?  I don't
think that patching the kernel will happen, as we are to close to
release for the kernel team to consider new patches for the kernel.  If
there is a way to patch toshset, then that might possible and I could
help with incorporating the patch and uploading if you can test.
