Not at all.  The only part of the definition that you cited that does not
explicitly involve "crossing the US border in the outward direction" is the
part about release to a foreign national, but that part is there because it
is presumed that said foreign national will promptly depart for home,
taking the "secret" with him across the border.  That bit is also
undoubtedly unconstitutional.

In any case, the rules require contemporaneous notice, not advance notice.
I see no way there could be a violation if a non-US admin looks over a
source package one day and sends a copy off to /dev/null at the Commerce
Dept the next.
