For completeness sake I want to mention that we discussed this issue on #debian-usrmerge.
The broad consensus there was, that while /usr/games was not initially part of this consideration, we do think that basically the same reasoning applies and we should avoid shipping conflicting binary names for this path as well, i.e. we would prefer if /usr/games is *not* exempted by policy.
But we also think that this should not be RC at this point though, i.e. at least for trixie. Helmut suggested to loop in the release managers regarding this particular issue.
