Yes.

See if the package without the patented bit is worth caring.
If you think that it isn't, you could file a bug against ftp.debian.org explaining
the issue and asking for it's removal. (I should think that, given the lack of a
maintainer, you as an almost adopter are one of the experts for the package, so this
might be in order.)

If you don't see a way around the patent issue, you probably should not waste your
time on it.
(Non-free+Patent issue isn't too attractive...)
