No.  Firstly, packages are allowed to contain the same directory;
that's not considered an overwrite (try dpkg -L and note that every
package includes the root directory; in fact IIRC this is a policy
requirement).

This is not a dpkg error, but a specific and deliberate preinst check
that does "return 1" or such, actively causing dpkg to stop.  See
/var/lib/dpkg/info/linux-image-*.preinst
