On second thought, are you sure the original header is not already
free software?  Can we see the terms for distributing and modifying
it?

It might be worth contacting the author to see if they are willing to
release the header under liberal terms (like the Zlib or Expat
license).  Some non-free libraries --- even expensive,
non-redistributable libraries --- have free headers to simplify the
task of making use of them.

Of course that doesn't change the other part.

No problem.  As a disclaimer, I should mention that I am not a Debian
Developer.  Even if I were, I wouldn't be the one deciding these
things. :)  We live in a world of no easy definite answers.
