Just searching the web a bit I found some blog post from mako about this[1].
But I'm still not sure if the trademark will affect in this case the use of the
name «Ubuntu» for a commercial purpose without the one already approved by
canonical with ubuntu-one service, in that case if some one want to modify this
client and use it with their own services will need to re-brand the software
though.
