Ah, well! As long as they are happy with this solution...

Anyway the copyright notice gives the *impression* that the drafter
knows very little about license compatibility (and the meaning of the
GNU GPL, given that something is offered under the GPL with no source).
Now I know that this is not actually the case, since you explained me
the real reason behind this awkward dual licensing, but the notice still
sounds strange.  :-(

That is unfortunate, really unfortunate.
I mean: it's unfortunate that they won't make source available, not that
that was your first suggestion!  ;-)

BTW, which piece of hardware is this?
Are we talking about CONFIG_SCSI_QLOGIC_FC_FIRMWARE, by chance?

Just to remember and avoid buying the card...
