Because it only terminates if you refust to comply with it, or if you
are unable to comply with it.  If a patent holder asserts that no one
may distribute software covered by their patent, and that includes the
GPLed software in question, then (through no fault of your own) you
cannot comply with the GPL except by not distributing the software, so
you must not distribute the software.
