And in fact, the fact that the NDIS or NVidia drivers *did* start off as Windows code and have a properly GPL'ed glue layer is the only reason why they're tolerated at all by the kernel community. Linus has said on several occasions words to the effect that "if NVidia hadn't convinced him that all of the closed .o files were basically of Windows/other heritage, they'd have heard from a lawyer"...
