I think we are having two misunderstandings at the same time. You seem to be talking about the specific case of modules for Linux, based on the specifics of the extra permission that Linus gave. That case is different and what I say does not apply to it. You are focusing on the definition of "derived work", but that is not really the issue. Copyright also covers use of a work as part of a larger combined work.
