The problem is that "no restriction on use" does not say anything
about allowing modifications or not (DFSG 3).

Same here. License should allow derived works to be distributed.
This license does not allow such thing.

The author seems not to be aware about the difference between "freeware"
and "free software", and he seems to think that "freeware" (no restriction
on use) is good enough.
