And then sending explicitly to those people, instead of to the list
server. There are NO guarantees that your mail will ever reach the
recipients that the list server claims are members, and there's a great
chance that people may have (un)subscribed in between your list request
and your list post.

It could *very* easily be argued, then, that if you _only_ wanted to send
to those people, you would have done, and you just stated very clearly
that you could have done.

You didn't, however.
