The binary doesn't violate the GPL. Only distribution of the binary
violates the GPL.

Anyway, I'm curious to know what accusation you are thinking of to
which being "unhelpful" might be a possible defence. I don't think
I've ever heard of a defendant pleading unhelpfulness.
