Caucho Public License



Caucho claims their modified QPL is Open Source:

I admit to being confused in terms of the Q Public License (the Open Source 
Certified QPL is the QT Public License), in addition to the fact that I can't 
tell if their license supersedes the QPL, adds to it, or what.

Caucho Public License
                                              version 1.0

                 Caucho Technology ("Caucho") permits redistribution, 
modification and use
                 of the accompanying software and documentation ("the 
Software") under
                 the Q Public License version 1.0 ("the QPL")
                 provided that the conditions of this license ("the License") 
are met:

                 1. Redistributions of the Software in source or binary form 
must include
                    an unmodified copy of the License, normally in a plain 
ASCII text
                    file named LICENSE, and an unmodified copy of the QPL, 
normally in a
                    plain ASCII text file named QPL.

                 2. Caucho Technology reserves all rights to its names, 
trademarks and logos.
                    In particular, the names "Resin" or "Caucho" are 
trademarks of
                    Caucho Technology and may not be used to endorse products 
derived from
                    this software.  "Resin" or "Caucho" may not appear in the 
names of
                    products derived from this software.

                 3. Caucho Technology requests that attribution be given to 
Resin
                    in any manner possible.  We suggest using the "Resin 
Powered"
                    button or creating a "powered by Resin(tm)" link to
                    http:/www.caucho.com for each page served by Resin.

                 4. If you transmit any improvement or modification of the 
Software to
                    Caucho, you agree to assign the copyright of the 
improvement or
                    modification to Caucho Technology.

                 5. The License will terminate immediately without notice from 
Caucho
                    Technology if you fail to comply with any provision of the 
License or
                    the QPL.  Upon such termination, you must destroy all 
copies and
                    derived works of the Software.  You may terminate the 
License at
                    any time by destroying all copies and derived works of the 
Software.

                 6. The Software is provided "AS IS," without a warranty of 
any kind.
                    ALL EXPRESS OR IMPLIED REPRESENTATIONS AND WARRANTIES, 
INCLUDING ANY
                    IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A 
PARTICULAR PURPOSE
                    OR NON-INFRINGEMENT, ARE HEREBY EXCLUDED.

                 7. CAUCHO TECHNOLOGY AND ITS LICENSORS SHALL NOT BE LIABLE 
FOR ANY DAMAGES
                    SUFFERED BY YOU OR ANY THIRD PARTY AS A RESULT OF USING OR 
DISTRIBUTING
                    THE SOFTWARE. IN NO EVENT WILL CAUCHO TECHNOLOGY OR ITS

                 8. Any action related to the License or the QPL will be 
governed by
                    California law and controlling U.S. federal law. No choice 
of law
