Sorry for the slow response.  I'm guessing this was fixed by
v2.6.39-rc2~7^2~8^2~24 (ath9k: Fix kernel panic in AR2427,
2011-03-21), v2.6.39-rc2~7^2~8^2~20 (ath9k: Fix kernel panic caused by
invalid rate index access, 2011-03-23), or some othe related change
from around then.

So: did I guess correctly (i.e., was this fixed by 2.6.39)? :)

What would actually be useful to know is the version number of some
recent (e.g., 3.0.x) kernel that exhibits or does not exhibit the
problem.  Hopefully the latter.
