The Ubuntu oneric kernel has a working aufs module git://kernel.ubuntu.com/ubuntu/ubuntu-oneiric.git (tag Ubuntu-2.6.39-3.10) I cherry-picked the aufs module from it and applied over 2.6.39.1 vanilla kernel with success. I am attaching here the patch for aufs against http://www.kernel.org/pub/linux/kernel/v2.6/linux-2.6.39.1.tar.bz2
