Chris Wilson committed a patch for this to upstream here https://bugzilla.kernel.org/show_bug.cgi?id=22672#c42 which can be downloaded here https://bugzilla.kernel.org/attachment.cgi?id=43272 and I can confirm that this patch fixes the issue with 2.6.37.
