Bug#433103: linux-image-2.6.21-2-686: Non GPL closed source drivers accepted

After upgrading to linux-image-2.6.21-2-686 I cant compile
drivers with closed source parts, in my case a fax driver
for a old AVM  ISDN pci card, because the kernel does not accecpt
non GPL drivers.
I get the following error message:
