I've just found a bug report that solved this issue for me from a different 
angle :-)

i also like to add that, while not disabling acpi with the kernel command line 
parameter (acpi=off) the Fn7=Fn8 brightness special function keys work fine 
on kernel 2.6.21-2 until X loads (with ati -6.6.2 - unstable video driver).
loading vesa xorg video driver makes this keys continue to work in X.

so let's see if we can close this one ?
