I think you are using rather old patch / package;
I believe above problem is already fixed:
2nd chunk of <http://www.kame.net/dev/cvsweb.cgi/apache13/src/main/http_vhost.c.diff?r1=1.17&r2=1.18&cvsroot=apps>
and <http://www.kame.net/dev/cvsweb.cgi/apache13/src/main/http_vhost.c.diff?r1=1.20&r2=1.21&cvsroot=apps>
