4.13. I can't remember policy ever say 'MUST', so I read 'should' as
'must'.

On other hand, as far as I understand we need it only because author
of git-annex is going to use it. Maybe we can defer this problem to
point when he release his new verion, that depends on hlibgit2?

There is discussion about upgrade on hlibgit2 issue tracker, last
comment is 16 Dec, so there is hope for upstream upgrade just-in-time.
