What if the firmware has a license on it that doesn't permit
redistribution in non-free?  Then what?

Well, if 2.6.27 in fact fixes a large amount of the firmware problem,
and happens to be a long term support kernel which is going to be used
by many distributions, then perhaps releasing Lenny with 2.6.26 is the
wrong choice and should be reconsidered.

Sometimes.  Certainly some hardware doesn't do anything without its
firmware.  Perhaps alternate firmware could be written, although often
there isn't any documentation around to do that.
