Better this way: Ask Atmel whether they allow unmodified distribution independent of the GPL (which does not work anyway), and then a) put the whole package in non-free or b) put the .hex files in non-free and the rest of the driver in main, if the driver code is any use without the .hex files. <Sidenote> It looks as if everytime we can get rid of a good reason for non-free (e.g. viable acroread alternatives), new reasons (firmware for drivers) arise.
