when using openssh
sshd version OpenSSH_3.0.1p1
with uselogin set to no
with pam.d/ssh having pam_limits.so in it
and limits that work fine when uselogin is set to yes and pam.d/ssh does not have pam_limits
it checks limits/resources improperly and will fail when it tries to fork() when someone logs in
