X11R6.4 is non-free. X11R6.3 is, and will continue to be, free.
If I remember correctly, the X (pre-6.4) license permits to create
spring-off programs - I suggest to start a new, really free X; with really
free sources (that is, access to development versions etc.), it'll
probably have X11R6.4 functionality and more before the closegroup
releases its next version.

in the subject.
