Ian did answer your question, and I agree with his interpretation that
this part of the FSSTND doesn't apply:

  (FSSTND 3.1)
  If /bin/sh is Bash, then /bin/sh should be a symbolic or hard link to
  /bin/bash since Bash behaves differently when called as sh or bash.
  pdksh, which may be the /bin/sh on install disks, should likewise be
  arranged with /bin/sh being a symlink to /bin/ksh.

The "likewise" implies that the second sentence only takes effect if
/bin/sh is ksh.  Nothing is said about ksh's location when /bin/sh is
not ksh.
