And due to Apogee's idiotic position on this, we will likely not be able
to distribute rott at all, since it depends on data files.

I've re-mailed apogee to confirm that I'm talking about the shareware
data files, but I don't hold out much hope.

No.  Folks are NOT allowed to redistribute the data files under any condition.
