Yes, this is true. However, we also have the burden of hiring legal
counsel to defend ourselves, and this is the real problem: we plain
can't afford to do so - very few people can (generally it's only
corporations who do).

So, while we will legally be considered not-guilty or not-liable until
we are found otherwise (probably), we just plain don't have the
resources to establish the precedent or our not-liable-ness, and so must
simply bow to the patent holder's request - i.e., they get what they
want without a fight from us.
