Interesting. Would the following be a legitimate practice in the initscript?

rm -f /usr/sbin/foo.running
ln /usr/sbin/foo /usr/sbin/foo.running
start-stop-daemon --start --exec /usr/sbin/foo.running
;;
stop)
start-stop-daemon --stop --exec /usr/sbin/foo.running
rm /usr/sbin/foo.running
;;
