I would have assumed that, too, but since others did not share the
assumption, it seemed prudent to be explicit about it.  

I suppose it's always possible that the chair might change their mind
after seeing how votes are cast and the comments associated with those
votes.  Should the project choose to try and amend the constitution at
some point to address corner cases in the voting process or TC rules of
engagement exposed through this process, this might be a detail worth
addressing explicitly.

On the other hand, we have never needed the TC casting vote before, and
I sincerely hope we never do again.
