although it fails, the server runs, then evertime i use apt-get i keep
getting a server restart, anything i can do about it?

My guess is that it is failing to configure because mysqld was still
running the entire time (--configure calls "start" on the init script as
shown in the error). What does /var/log/daemon.log have to say about it?

well, found the problem, i disabled the debian-start check script, every restart to the database it might take me over 30mins to finish this check. Is there any smart way to disable those checks? i don't like this idea that a script like this touch my database (around 1TB)
