apxs pulled from apache source 1.3.33

Is it intentional that you don't get apxs as part of apache source for 1.3.33, 
yet you were able to for 1.3.26?

To create mod_dosevasive.so I needed to get hold of apxs from apache source for 
1.3.26. I then used apache-modconf to 'load' the module into the binary 1.3.33 
version of apache which is the production server. It just seems strange that I 
had to do this.

Was apxs pulled for a reason, or have I got something wrong, and will the 1.3.26 
created mod_dosevasive.so cause any problems?
