I have an Agere Systems AC'97 modem on my IBM R40 laptop. It's a Winmodem 
which is designed to use the Windows operating system to do some of its work.  
I never got it to work satisfactorily even with the herioc efforts of the 
helpful folks at linmodems.org. Check their archives and you can follow my 
experience with the Agere modem and my R40 with Red Hat 9 Linux. (I'm 
currently running RH9, Knoppix --which is based on Debian Sid -- and WinXP. I 
plan to migrate to Debian Sarge soon.) I was trying to get the Agere driver 
(not open source) to work. IBM has dropped the link on their site to the 
driver, so I guess that even they realized that it didn't work right. I am 
currently using a Linksys Etherfast 10/100 + 56k modem PCMCIA card. It's 
annoying to have that appendage sticking out there, but it works great.

There have been some reports that another driver will work (Smartlink, if I 
remember correctly), though it's not specifically meant for the Agere modem. 
I didn't try that because they offer it only for use with their modems. Their 
end user licensing agreement states "The Software may only be used by the 
Buyer to upgrade the Buyer's existing version of the Product and may not be 
used with any other product not provided by Smart Link." Browse some of the 
IBM R40 reports at Linux on Laptops (www.linux-laptop.net) and you should 
find info on it. There's one report of a Linux install on an Acer Aspire, but 
that person hasn't gotten the modem to work.

If you would like help with this, I highly recommend the patient and 
knowledgable folks at linmodems.org. Read the instructions on their site 
before posting. Run their scanmodem program and post the results.
