See, the copyright holder has no problem if those files are distributed. They will not care. I can also reconfirm this by asking them. So the problem is if this can still comply with the DFSG. So the exception should be made by Debian. If this is not possible, maybe one workaround could be to make the paxkage without the firmmware files, and put them elsewhere on the web.
