I think it's fine.  The rule just amounts to a rule that the US
Government is required to behave like anyone else with respect to
copyright on computer software, rather than having special sovereign
status (which is the default rule fo the government with respect to
software).

So this legend invakes the special rule, but the special rule just
says that the US Gov't is on the same playing field as everyone else.
So it doesn't really discriminate.
