Isn't the GPL essentially a counterexample?  It was written with legal
counsel, and many people have criticised it for it complexity.  It has
also been an effective license that doesn't have any exploitable legal
holes.  It has prevented free-loading from even gargantuan
corporations.

If you were a small project, then I would recommend writing for (3),
because someone with a lot of resources could just clone it.  For
large projects (which LaTeX certainly is), something more legalistic
is important.
