Debian wants to distribute more than just source code patches (which
can form derivative works under copyright, but we can ignore this
problem for a moment).
This means that DJB's observation is not relevant for Debian. Even
DJB doesn't claim that you may distributed derived works (modified or
not) of copyrighted software.
