It appears to be ash, though I don't currently recall setting it to that:
sfere$ ls -l /bin/sh
lrwxrwxrwx 1 root root 3 Nov 20 22:19 /bin/sh -> ash*
The test appears to work properly when invoked manually, too:
sfere$ /bin/sh -c '[ ! -e /etc/papersize ]; echo $?'
1
ttfn/rjk
