There was a brief discussion[1] on -legal about this, and it seems that most of the people who responded (Glenn, Mark and David) agreed that the license fulfilled DFSG #1 [the aggregate clause]. Further, it was noted that the simple addition of a single character to the Font Software would (probably) allow it to be sold, so this clause was pretty easy to work around.
