Good catch!  I always forget about this one.

Yes, I suggest you use the following:

# Unknown net device (/class/net/eth0) (mv643xx_eth_port)
SUBSYSTEM=="net", ACTION=="add", DRIVERS=="mv643xx_eth_port", ATTR{type}=="1", KERNEL=="eth*", NAME="eth0"

It looks at the driver used for the device rather than the MAC address.
