It is, so the patch is completely bogus.

It still wouldn't be used at all in the xfree86 build...

The r128 and radeon 2D drivers don't deal gracefully with the DRM
failing to load the firmware. That's a bug which has been fixed at least
in the radeon driver in DRI CVS. I suggest those who insisted on
inconveniencing users by crippling the kernel-image packages dig up the
fix and provide it to the XSF. Alternatively, they could provide the
microcode in a convenient way.

Of course, people can also use non-Debian kernels or
drm-trunk-module-src, which still have the microcode built in.
