Perhaps so, but that's not always an excuse. I'd hope that the sysadmins
and prosecutors would have some judgement about when and how to press
chagers, and when not to.

This I agree with, too. I don't mean to seem hostile, but just because a
cracker doesn't physically invade someone's home or business, it does not
mean that cracking shouldn't be viewed as about the same as burglary.
Still, I appreciate that not everyone views it the same way.
The old-school MIT hackers made plenty of information available about
lockpicking. They didn't encourage larceny, just creative exploration and
avoidance of bureaucratic hassles. They often extended this notion to,
shall we say, creative exploration of computer systems. I can understand
this, but no legitimate exploratory hacker would mess with "ls", "du" and
use smurf attack programs.
