You are right.  It still intrigues me that paragraph creates a headline,
while subsection does not (I have just made some tests with subsection
right after section, and no page break is put between them); it is
strange, isn't it?  Lamport's book does not speak about it.

I am not convinced the \section does not start, looking into latex.ltx
I see a \@secpenalty appearing there. It is about he penalties, and
probably the \paragraph penalty is much smaller than the section
penalty.

But these are all questions you
- either have to accept, because LaTeX is written like it
- complain to the LaTeX3 team (which is probably as useful as sending
   it to the northpole)
- ask your local TUG guru

You are right, it is useless here.  Still a bug is a bug, no matter if a
useless thing exists or not.

You say it is a bug, but not everyone need to agree on that. I assume
that the different penalties were set on purpose.

If oyu are uhappy with the way LaTeX works, use plain TeX, then you
can define your own penalties and layout and everything to the last point.
