They are no fool and they are not shifting anything. Microsoft is in a
different business than the spy business, when it comes to Office 365.
They're mixing apples and oranges.

Microsoft is scaring Gmail users reminding them that they're getting a
gratis inbox in exchange of being spied for free. Their solution is to
sell small enterprises their 'cloud' based version of Office so that
Microsoft will keep their data in a lock and force them to pay them
forever or never take their data away.

You can see how these are two totally flawed business models. You can
also see how Microsoft is scaring one target audience (consumers) while
trying to have another target buy stuff...
