A quick look at
http://www.macromedia.com/software/flash/open/licensing/fileformat/license2.html
seems to reveal that the fileformat is _not_ free:

Section 3b includes:
> You agree to identify the SWF output from within your Product, whether from the Save As, Export, or equivalent menus, as ?Macromedia Flash (SWF)? and to refer to Macromedia Flash


Also, try wikipedia (I can't reach the site at the moment).
